You can request access to personal information we hold about you and ask us to update, correct or delete it. Please note that we may decline your request to delete the information if we are required to keep it in terms of other legislation or if it has been de-identified.

You may object to the processing of your personal information if you think that, in your situation, it will affect your fundamental rights and freedoms. Even if you object, however, we may be compelled by legislation to continue processing your information. You may also request that we suspend the processing of your personal information in the following situations:

  • If you want us to establish the information’s accuracy;
  • If our use of the information is unlawful, but you do not want us to delete it;
  • You have objected to the use of your data, but we need to verify whether we have overriding legitimate grounds to use it.

You have the right to unsubscribe from any direct marketing communication we send you.

We do not share your personal data with third parties outside of South Africa.

The TYREMART Franchise subscribes to the Code of Conduct of the Automotive Industry of South Africa and all TYREMART Franchisees are committed to:

  • Providing goods and services that are safe and at prices that are fair and reasonable;
  • Publicly acknowledging the consumer's rights to be heard, to be informed, to have the right to safety, the right to choose, and the right to redress with regard to the South African Automotive Industry and, more particularly, the TYREMART franchise-group of Tyre & Parts Fitment Centres.
All TYREMART members are registered with the Motor Industry Ombud of South Africa, accredited as the industry ombud in terms of section 82 of the Consumer Protection Act, 2008 (Act No. 68 of 2008)

The employer undertakes that the content of the TYREMART Code of Conduct has been brought to the attention of and explained in understandable terms & language to every employee and the each employee has indicated that he/she understands the content.

PREVENTION OF CORRUPTION & CONFLICTS OF INTEREST

PURPOSE OF THIS CODE OF CONDUCT:

The TYREMART Prevention of Corruption & Conflict of Interests Code is intended:

  • to provide measures to prevent and combat corruption, corrupt activities and any conduct that could amount to a conflict of interest between employees and the employer, as well as other parties involved in a business relationship with the employer;
  • to define what conduct in the workplace will constitute corruption, corrupt activities and conflicts of interest;
  • to provide for the offences of corruption and offences relating to corrupt activities in the workplace.
  • to place a duty on employees to report certain conduct.

NO BENEFITS MAY BE RECEIVED BY THE EMPLOYEE OR ANY OTHER PERSON:

Without the prior written approval of the employer, no employee may directly or indirectly accept or agree to accept offers of any reward, gift, gratification or hospitality from person other than what is due to the employee by the employer as remuneration or reward in terms of the contract of employment.

This prohibition applies both to a benefit for himself / herself and for the benefit of any other person, natural or juristic.

NO BENEFITS MAY BE OFFERED OR GIVEN TO ANOTHER PERSON:

No employee may give or agree or offer to give to any other person any gratification, favour, benefit or reward for the benefit of that person or any other person, with the intention to or in order to influence the other person to act in a way that:

  • is illegal, dishonest or biased;
  • results in a favour or any gratification being given to the employee in return to which he / she is not otherwise entitled in terms of the contract of employment;
  • constitutes misuse or selling of information or material acquired in the course of employment;
  • amounts to a breach of trust between the employee and the employer or any other person who is a supplier to or client or competitor of the employer;
  • constitutes abuse of a position of authority;
  • is a violation of a legal duty or set of rules;
  • amounts to unauthorised or improper inducement to do or not to do anything that will result in a favour or any gratification.

CONSEQUENCES OF CONTRAVENTION OF THIS CODE:

Acts of Corruption and Conflict of Interest are generally accepted as a serious enough offence to merit possible dismissal.

An employee who engages in conduct in contravention of these prohibitions will be subject to disciplinary action that may result in dismissal.

Depending on the nature of the conduct, such employee also be subject to criminal and/or civil action.

Protected Disclosures Code


The TYREMART Protected Disclosures Code is intended:

  • to place a duty on employees to report criminal or other irregular conduct in the workplace;
  • to guarantee that the employee is protected from workplace reprisals on account of having made a protected disclosure.

A “protected disclosure” is the disclosure of information regarding the conduct of the employer or an employee of the employer that:

  • shows that a criminal offence is being committed or is likely to be committed;
  • a person has failed to comply with a legal obligation;
  • a miscarriage of justice has occurred;
  • the health or safety of a person is endangered;
  • there is unfair discrimination;
  • the environment is likely to be damaged.
Employees are required to disclose information about criminal or other irregular conduct in the workplace.

Any such information may be disclosed directly to the employer (Dealer Principal).

In the event of such information being in regard to the conduct of the employer, the employee may disclose the information directly to TYREMART Franchise Head Office.
